Why Shopify is risky for e-cigarette & disposable stores
E-cigarettes, pods and disposables are electronic nicotine delivery systems (ENDS). Shopify's 2026 enforcement removes them platform-wide, and a 25-state attorney-general coalition has pushed both Shopify and the card networks (Visa, Mastercard, Amex, Discover) to cut off unauthorized e-cigarette sellers. Staying on Shopify means living one enforcement sweep away from a frozen store.
Compliance you can't skip (ENDS)
ENDS carry the heaviest shipping and reporting burden of any category we migrate. Your new store has to be built around these rules:
- USPS ban: ENDS are non-mailable via USPS; you must ship with a private carrier under a current certified carrier agreement (UPS and FedEx have heavily restricted consumer ENDS since 2021).
- ATF registration: Register with the ATF as a delivery seller before your first shipment, plus the tax authorities of each state you ship into.
- Monthly state reports: File PACT Act delivery reports by the 10th of each month, separately for every state — ship to 30 states, file 30 reports.
- FDA PMTA: Only FDA-authorized products may be lawfully marketed; per the FDA (2026), a pending application is not a safe harbor.
- Age verification: Identity verification at checkout (not just a date-of-birth box) plus adult signature on delivery; verify name, DOB and address against a government-data database.
- State flavor bans: Geo-block restricted states (e.g. flavored-vape bans) at checkout.
