Why Shopify is risky for cigar & tobacco stores
Shopify's acceptable-use rules treat tobacco as a restricted/high-risk category, and Shopify Payments (like Stripe, Square and PayPal) won't process cigar sales — pushing you to costly external gateways or off the platform entirely. A store you own removes that exposure for good.
Compliance for cigars (lighter than vape)
The headline difference: premium cigars sit outside the strictest tobacco shipping rules. But age and tax rules still apply:
- PACT Act exemption: Cigars are not covered by the PACT Act and remain mailable via USPS — unlike cigarettes, ENDS and smokeless tobacco. Note that 'little cigars' can be treated as cigarettes.
- FDA premium-cigar status: Premium cigars have a distinct FDA status following litigation that defined an FDA-exempt premium-cigar category — lighter than the deeming rules that hit cigarettes and vape.
- Age 21+ verification: Federal Tobacco-21 still applies; verify age at checkout and on delivery.
- State excise taxes & licensing: Tobacco excise taxes and retailer/distributor licensing vary by state and can apply to remote sales.
- Adult marketing: Keep marketing adult-only and compliant with tobacco advertising rules.
